With the placement of this order, you agree to Hope 4 Recruitment Ltd.’s terms and conditions of service.
1. Terms and conditions for services ordered
In the below terms and conditions:
- A. Hope 4 Recruitment Ltd is conducting business as a recruitment agency ("the Recruitment Agency") and.
- B. Client is the person/entity who has placed an order for the candidate sourcing. It can be a business or a person acting on behalf of the business.
- C. The headings in these terms and conditions are for convenience only and do not affect their interpretations.
2. Acceptance and Authority to Act
- A. With the placement of this order with Hope 4 Recruitment Ltd and instructing us to begin the recruitment process, the Client agrees to the following terms and conditions.
- B. The Client hereby grants Hope 4 Recruitment Ltd the authority to represent it in the pursuit of suitable Candidates to fulfil its job vacancy requirements.
- C. The Client also grants Hope 4 Recruitment Ltd express permission to advertise and publicize the job vacancy through various channels including but not limited to third-party websites, job boards, social media platforms, and any other methods deemed appropriate at the discretion of the Recruitment Agency.
- D. The Client acknowledges that the phrase "commencement of Engagement" is defined as the day the job adverts are launched by Hope 4 Recruitment Ltd on behalf of the Client. Hope 4 Recruitment Ltd will inform the client via an email on the day of commencement of engagement.
3. Standards Required
The Client agrees to supply Hope 4 Recruitment Ltd with complete and accurate details required to assess the suitability of each candidate in question. In this context, the Client commits to providing the following information:
- The name and contact details of the person who will be interviewing the Candidates.
- The date on which it is proposed that the Engagement should begin. Proposed date for the commencement of engagement.
- The specific role to be occupied, encompassing the nature of duties the Candidate is expected to perform, the designated location of employment, and the prescribed working hours during which the Candidate is required to fulfil their responsibilities.
- Identification of any potential health or safety risks associated with the Engagement, along with a description of the precautions or preventive actions undertaken by the Client to address these risks.
- Details of the necessary experience, training, qualifications, and any legal or professional body-required authorisations that the Candidate must have to perform in the role. This also includes a clear outline of any expenses that will either be paid by or to the Candidate.
- The minimum remuneration rate and any additional benefits associated with the respective position, along with the specific payment intervals for these compensations.
The Client agrees to provide the above information in writing before the commencement of the Engagement.
B. Hope 4 Recruitment Ltd will undertake diligent measures to ascertain the suitability of each Candidate. Nevertheless, it is incumbent upon the Client to conduct its own thorough verifications and assessments to ensure each Candidate's appropriateness for the role. It is the Client's obligation to verify and confirm the following information:
- Candidates’ references.
- Verification of the Candidate's professional and academic credentials, ensuring the accuracy and truthfulness of the information presented in their CV.
- DBS Records.
- Candidates Right to work in the UK status.
- Any medical conditions.
- Any other authorisations and checks required by law.
C. The Client acknowledges its responsibility to be informed about and adhere to all pertinent employment laws and regulations, including, but not limited to, the Equality Act 2010, the Working Time Directive, the Workplace Pension Scheme, and Minimum Wage legislation. 4. Acceptance of Offer
The Client agrees to notify Hope 4 Recruitment Ltd in writing of the acceptance by the relevant candidate. If the Client offers employment to the Candidate and the Candidate accepts, but the Client later chooses to withdraw the offer, Hope 4 Recruitment Ltd will retain 40% of the total fees paid.
5. Payment method
The Client must pay Hope 4 Recruitment Ltd service fee upfront. Services will begin only after payment clearance. The Client must make the payment through electronic funds transfer, either via the online payment portal or by direct bank transfer.
6. Free Replacements
- A. If the Candidate terminates their employment with the Client (excluding circumstances of redundancy, constructive or unlawful dismissal, reduced workload, alteration in job scope, or relocation of the Client) within 60 days from the start date of employment, Hope 4 Recruitment Ltd will provide a replacement service at no additional cost. This is only applicable in the case of permanent recruitment.
- B. If for any reason, the Client does not inform Hope 4 Recruitment Ltd by email within three working days of the Candidate's departure, Hope 4 Recruitment Ltd will not provide a replacement.
7. If Client recruits Candidates from Hope 4 Recruitment Ltd after Engagement ends
In the event that the Client, or any affiliate of the Client, engages a Candidate introduced by Hope 4 Recruitment Ltd for employment, whether on a permanent, contractual, freelance, temporary, or any other basis, within a period of six calendar months from the commencement of the engagement or from the date of the Candidate's departure, a full Introduction Fee shall be due and payable to Hope 4 Recruitment Ltd, irrespective of any previously settled fees. For ALL Candidates, the “Engagement Fee” will correspond to the full price of the service. If the Client fails to inform Hope 4 Recruitment Ltd of the successful employment or engagement of a Candidate supplied by Hope 4 Recruitment Ltd, either on a permanent, contract, freelance, temp or any other basis, a fee of £5,000+ VAT will be charged. There shall be no entitlement to a refund of any kind following such subsequent Engagement.
8. Liability
- A. Hope 4 Recruitment Ltd shall have no liability for any delay or failure in performance of its obligations to the Client where this occurs from matters outside its reasonable control. Hope 4 Recruitment Ltd is not liable to the Client in connection of arising out of this Agreement or use of the Candidate or in relation to the engagement or for the following:
- Any damage to profit or loss of profit, use, savings, contract, goodwill, or business or
- Any consequential or indirect damage or loss whether arising by negligence, breach of statutory duty, breach of contract, any misrepresentation, restitution, other tort or otherwise and whether arising under any indemnity and whether caused by any total or partial failure or delay in supply of the services of the Candidate by Hope 4 Recruitment Ltd
- B. The Client shall indemnify and keep indemnified Hope 4 Recruitment Ltd against any costs, claims or liabilities incurred directly or indirectly by Hope 4 Recruitment Ltd arising out of any Engagement, including (without limitation) because of:
- any breach of this Agreement by the Client; and
- any breach by the Client or any associated company of the Client, or any of its or their employees or agents, of any applicable statutory provisions (including, without limitation, any statutory provisions prohibiting or restricting discrimination or other inequality of opportunity).
Any failure by Hope 4 Recruitment Ltd to enforce at any time any one or more of the terms of this Agreement shall not be deemed a waiver of such rights or of the right to subsequently enforce the terms of this Agreement.
9. Confidentiality of Information
The Client agrees to the following:
- Keep all information, commission payments, terms, and any contract details regarding the agreement, strictly confidential.
- Not disclose the confidential information to any person without Hope 4 Recruitment Ltd.’s prior written consent.
- Act in good faith always in relation to Hope 4 Recruitment Ltd, and their Candidate's, confidential information.
- Not use any of Hope 4 Recruitment Ltd, or their Candidate's, confidential information for any purpose other than for the Engagement set out in this agreement.
10. Termination
This agreement may be terminated by either party in the event of an unsuccessful recruitment campaign.
11. Variations and Amendments
No variation to these terms on behalf of Hope 4 Recruitment Ltd can be made otherwise than in writing signed by a director of Hope 4 Recruitment Ltd.
12. Late Payments
Hope 4 Recruitment Ltd will add interest to any payments that are late under this Agreement. We also hold the right to charge for any costs of recovering the debt and to apply statutory interest on late payments at a rate of 8% above the Bank of England base rate, as allowed by the Late Payment of Commercial Debts (Interest) Act 1998. Any late payment will result in the Client relinquishing the entitlement to a free replacement or rebate period.
13. Interpretation
You acknowledge that you have not relied on any statement, promise or representation made or given by or on our behalf. These conditions apply to the contract to the exclusion of any other terms that you try to impose or incorporate, or which are implied by trade, custom, practice, or course of dealing.
14. Governing Law
This agreement shall be governed by the laws of England and Wales. By commencing engagement with Hope 4 Recruitment Ltd, you hereby accept these terms and conditions.
